Within the scope of real property right the Legal Office i.a.:

  • conducts legal audit for the real property,
  • renders legal support services at the moment of purchase and sell of a real property, including purchase of the real property by foreigners,
  • prepares projects of various agreements within the scope of real property trading, including exclusive commercial intermediation, preliminary and conditional agreements as well as analysis the provisions of intermediation agreements, preliminary and conditional provisions prepared by the latter party of the transaction,   
  • within the course of legal support of the transaction we concern the issues of securing claims on real properties, establishing limited property rights on real properties (mortgage, usufruct, easement, etc.),
  • we render legal support at the moment of conclusion agreements of selling/purchasing real properties, including preliminary and final agreements with developers,
  • we prepare analysis of developer selling agreements in a view of their compliance with the provisions of law, including applying by developer companies prohibited clauses, compliance with the provisions of the Competition and consumer protection Act, as well as we negotiate on behalf of our Client contractual terms of such agreements,
  • we provide analysis and establishments in the scope of legal status of a real property, including perpetua books and mortgage proceedings before a court of civil law regarding the agreeing perpetual book contents with the actual legal status,
  • we conduct proceedings within the scope of law of inheritance,
  • we prepare projects of agreements regarding cancellation of joint ownership, including agreements on distribution of the testators estate, as well as we conduct proceedings before a court or a notary regarding cancellation of the joint ownership,     
  • we conduct court proceedings regarding matters related to acquisitive prescription of a real property,
  • we advise and prepare projects of agreements regulating the manner of use of a common real property, we advise and render legal services regarding the management of a real property for property managers and housing association,
  • we advise on real estate trading and conducting the investment on real properties from the perspecitve of administrative proceedings regulations,
  • we give legal opinions in the scope of: etablishment and transfer of perpetual usufruct, transformation of perpetual usufruct into the right of ownership, share in the right of ownership or perpetual usufruct and cancellation of joint ownership,
  • we prepare projects of agreements regarding the establishment of limited property rights,
  • we advise on handing over real properties in use for the benefit of third party persons, we prepare and opinion projects of lease agreements, tenancy agreements, agreements of lending for use, etc., moreover we assist in the situation of non-performance or improper performance of the binding agreements by third party persons,   
  • we conduct proceedings in the scope of recovering real property rights occupied by third party persons (eviction proceedings).
